Bylaws Notification


BYLAWS NOTIFICATION

An amendment notification was approved by the State Board on June 19th to replace the entirety of the bylaws as they exist now with the following:

  1. The Libertarian Party of Delaware organized under these bylaws shall be governed by its State Board, consisting of:

  3. David Rogers
  4. Mary Pat Dittmeyer
  5. John Machurek
  6. Nicole Shaw
  7. Aarika Nelson
  8. Brandywine Kerchevall
  9. Gwendolyn Jones
  10. Joseph DiPasquale

  12. Mark Parks
  13. Steve Newton
  14. Carol Moore
  15. Roger Stemler
  16. Vernon Proctor
  17. Robert Sigler
  18. Hunter Hastings
  1. Decisions shall be made by a majority vote of a quorum consisting of the lesser of six or a majority of members.  Votes shall be conducted electronically with electronic votes remaining open for 48 hours.  Failure to respond to four consecutive votes shall be construed as a resignation and removal from the above listed Board.  Vote results shall be kept private to the extent permitted by law.  These Bylaws may be further amended by a majority vote of all Board members or upon resignation of a Board member to reflect the Board’s new composition.
  2. Upon the resignation of the last remaining Board member, the Libertarian Party of Delaware is dissolved and any remaining assets shall be transferred to the designated successor organization.

Statement from the Chair


STATEMENT FROM THE LPD CHAIR

Yesterday the Delaware State Board of Elections determined that the Mises Caucus faction that secured a minority of State Board seats at the 2021 convention and were expelled in October are entitled to ballot access and that we are not.  Our candidates have been removed from the ballot.

During that meeting, I conceded that without ballot access, I had no interest in being attached to what the MC will do to the "Libertarian" brand and would not hold onto a "Libertarian" party organization in Delaware parallel to a ballot-qualified Mises controlled "Libertarian" party.

What several people seem to have concluded from that is that the actions taken by the State Board in October and since have now been proven illegitimate and that the Mises Caucus controls the organization that held its convention in Felton last year and that I'm conceding all of that.

I understand that the MC thinks I have that kind of power, but they're idiots and I do not. Neither does the State Board of Elections in the context of the meeting that occurred yesterday.

Absent any further developments, the State Board of the LPD that expelled the MC from its membership still controls that LPD organization, though I concede that organization is no longer worth much without its ballot access or national party affiliation, and that it is tethered to a toxic brand.

Nevertheless it is the State Board and its acknowledged county affiliates that will determine the course of this organization. Not the State Board of Elections, nor the National Libertarian Party.

This is to say that until these outstanding issues are resolved, we are continuing as normal, with the caveat that our nominated candidates are no longer ballot qualified. We will be transitioning to something new to continue advocating for the principles that we believe in and you'll learn what that is and how you can help in the same places you have over the last 12+ years.

Inland Bays Wastewater Facility


INLAND BAYS WASTEWATER FACILITY

Central to the Libertarian philosophy is respect for individuals and individual rights, including individual rights to property.  One important property right is the right for others not to damage their property, including the environmental quality of that property.  In an ideal Libertarian society, accessible court systems and well established precedents would delineate clear boundaries preventing large corporations from infringing on the rights of household property owners, but we do not inhabit such a world.  As an imperfect mechanism of protecting these rights, these corporations must apply for permits from various levels of government.  This permitting process should endeavor to emulate the same kind of protection for environmental property rights, but it often does not, and approval for permits essentially grants a blank check to pollute neighboring properties so long as the damage fits into arbitrary regulatory limitations or at least is not discovered to have violated them.

This is unjust.

The Libertarian Party of Delaware calls on the Delaware Department of Natural Resources and Environmental Control to ensure that the pending application for permitting an expansion of the Inland Bays Wastewater Facility meets these standards and ensures the safety and environmental quality of neighboring property owners and by extension the health of those residents.

Membership Bylaws Amendment Notification

Article VII: Membership (Existing)

Any person who agrees to abide by the terms of these articles is a member of the LPD provided they have met at least one of the following criteria for at least 60 days:

  1. Is a registered Libertarian according to the Commissioner of Elections.
  2. Is a sustaining member of the National LP residing in Delaware.

Members must also be approved by a majority of the State Board, and may be approved on a temporary or permanent basis. Membership may be revoked by a 2/3 vote of the State Board.

Members may also be approved on a temporary or permanent basis by a 2/3rds vote of credentialed delegates in Convention, or the credentialed delegates may elect to waive the approval requirement for the duration of the convention by a 2/3rds vote.

Impact Investigation: This amendment would cause dues paid to establish membership to be directed to the LPD rather than any national party.

2022 Libertarian Convention


2022 LIBERTARIAN NATIONAL CONVENTION

The true Libertarian Party of Delaware did not send delegates to the Libertarian convention in Nevada last weekend.  While we do not acknowledge the validity of the constructive disaffiliation carried out by the Judicial Committee early this year, we do admit that between the actions of the Credentials Committee chaired by our former regional representative, Susan Hogarth, who has been carrying water for the Mises Caucus since the beginning of our dispute, and the projected composition of the other convention delegates, we knew there was no hope that we would be able to prevent the takeover of the National Libertarian Party with only four votes that were unlikely to be seated anyway.

This should in no way be interpreted as approval of what was done to the Libertarian Party last weekend.  The new direction of the LNC and the platform are not reflective of libertarian values.  Bigotry is irrational and repugnant.  The bigotry displayed and tolerated by the newly elected members of the LNC and the JC are an embarrassment.  We also continue to believe that no government should interfere with the reproductive choices made by women in consultation with their doctors and families.  Immigrants who have committed no acts of aggression against others should be welcomed.  Transgendered individuals should be comfortable in schools they are required by law to fund and attend.  Libertarian views on taxes, war, and regulation are incomplete without policy and cultural preferences for tolerance in opposition to historical tendencies of discrimination and oppression.

Political movements come in waves and we retain hope that the invasion of the Libertarian Party will recede in time to repair our relationship with the national organization, but we will be glad to be separated from a National Libertarian Party that does not return in short order to the principles it has stood for since its founding.  We will continue to stand for those principles and collaborate with any others who share them.
